U.S, U.N diplomatic shenanigans allow Sri Lanka Genocide cover

The United Nations, U.S., and India, the international players complicit in first failing to prevent, and then covering the Sri Lanka's 2009 Genocide of Tamils, have provided the proverbial succor, "more time and political space" to Sri Lanka to investigate itself, allowing the genocidal state to avoid culpability for the crimes. While the "inability and unwillingness" of Sri Lanka for conducting credible investigations for criminal conduct of the island's key politicians and the military has been historically proven, the US has been instrumental in supporting and shaping UN resolutions in buying Sri Lanka time to skirt around the critical obligations for a credible criminal investigations. Six years have passed and UNHRC resolutions are continuing to provide more "time and political space" to Sri Lanka.

Time and space argument was first proposed by UN Secretary General (UNSg) Ban-Ki-Moon on July 30, 2009, when the UN policy committee met at UNHQ to discuss Article 99, Commission of Inquiry and accountability related issues.

On June 23, 2009 meeting, UN Office of Legal Affairs recommended usage of Article 99 to institute commission of inquiry and a follow up meeting was held on July 30, 2009. In this meeting, Ban-Ki-Moon, said "“the Government should be given the political space to develop a domestic mechanism” and that only if this did not occur within a limited time frame would the UN lookat alternatives. (Page 96, Para 173 - Petrie Report).

The "limited time frame" was never followed up by the UNSG, as one could see that even the 2015 UNHRC resolution is again providing additional time, after a failure to do so by the GoSL during the past six years.

Sri Lanka's Sinhala politicians, assisted by the diplomatic core, have honed the technique of delaying investigations in many UN meetings where there were deliberations on "domestic or international" criminal investigations. A recent article by Dr Dayan Jayatilleka illustrates the approach. Criticizing the Sirisena government for co-sponsoring the UNHCR resolution, Jayatilleka says, "[t]his government could have easily refrained from embracing Zeid al Hussein’s dastardly, toxic report.... [The Government] could have asked the Council for [more] time to study the Zeid report and requested the Council to study the Sri Lankan counter-report."

Unfortunately, a section of ITAK Tamil politicians, piggybacking on the respect afforded by the political struggle of the late statesmen like SJV Chelvanayakam, serve as willing accessories to the US-India-Sri Lanka triumvirate’s genocide-erasure project. However, fortunately for the relatives of the victims of genocide, the Northern Provincial Council led by Justice CV Wigneswaran, North-East civil society activists and leading Bishops, continue to provide optimism and hope by acting as antidote to the ITAK actions on the genocide front.
