Judgement reserved on rights case

Supreme Court reserved the order on a fundamental rights application filed by Liverpool Navigation Ltd challenging the refusal of security clearance to sail their cargo ship from Colombo to the Northern coastal seas.
The Bench comprised Justices Dheeraratne, Wijetunge and Shiranie Bandaranayaka. The application was filed by the Liverpool Navigation Ltd through their Counsel Gowry Shankary Tahavarasa. Senior Counsel Faiz Musthapha submitted to Court that Emergency Regulation 4 of 1995 notified that there shall be established a zone to be known as the Prohibited zone and that no person shall enter such zone in any vessel except with written authority. Mr. Musthapha continued that in terms of the regulation the prohibited zone comprises the administrative districts of Amparai, Batticaloa, Trincomalee, Mullaithivu, Jaffna, Killinochi, Mannar, Puttalam etc. In compliance with the regulation, the petitioner made an application seeking security clearance to sail between Colombo and Jaffna, he concluded. Faiz Musthapha with Manohara de Silva and Saliya Pieris instructed by Gowry Shankary Thavarasa appeared for the petitioner company.
