Jaffna University teachers remind SL President about rule of law

0“There is now no anti-state terrorism in Jaffna. An important part of consolidating peace is for the State to conduct itself in a manner that induces respect for the rule of law,” reminded Jaffna University Science Teachers’ Association in an appeal sent on Friday to Sri Lanka’s President Mahinda Rajapksa on grave and dangerous plight of students at the University of Jaffna. “Your Excellency well knows, having been in politics for several decades and in the center of two Southern insurgencies, that the defeat of an insurgent force does not extinguish the feelings or causes that gave rise to it. Such feelings are not a police matter, but are rather to be handled as part of the political task of reconciliation and rebuilding,” the academics reminded the SL President further.

Appellants granted time extention in Rajapakse war-crimes case

The United States Court of Appeals for the District of Columbia Circuit granted appellants’ motion for extension of time to file the Reply brief, by two weeks, in the appeal case against Sri Lanka's President Mahinda Rajapakse for civil damages on war-crimes charges, according to the court docket. The revised briefing schedule indicated that the Appellant's Reply brief will now have to be filed by December 7, 2012. Attorney for the Appellants, Bruce Fein, told the court that the the intervening holidays and his case work load had necessitated the request for extension and the Court granted his motion.

Colombo accelerates demographic genocide in Trincomalee

The Colombo government led by President Mahinda Rajapakse has been implementing a land appropriation policy to reduce the parliamentary strength of Tamils in Trincomalee district with the support of occupying Sri Lanka Army, say Tamil politicians in the district. While landless residents of the district have to fight for the allocation of half an acre per family, the outsiders brought down from south are allowed to clear forest lands 2 to 3 per acres per family. More than three hundred Sinhala families have been brought down from southern districts of the island and are allowed to clear forest area in Suriyawewa situated in Seruwila DS division at the rate of two to three acres per family.

Sri Lanka rejects 100 recommendations at UPR

A hundred recommendations that came out in the submissions of the member states of the United Nations at the Universal Periodic Review (UPR) on Sri Lanka have not enjoyed the support of Sri Lanka, reveal a draft document by the UPR working committee on Monday. The report also identified 110 recommendations as enjoying the support of Sri Lanka. All conclusions and/or recommendations contained in the present report reflect the position of the submitting State(s) and/or the State under review. They should not be construed as endorsed by the Working Group as a whole, said the draft report. At its 18th meeting held on Monday, the Working Group adopted the report on Sri Lanka India, Benin and Spain had been selected by the UN Human Rights Council as rapporteurs (troika) to facilitate the review of Sri Lanka.

Sri Lanka demands ‘time and space’ to complete genocide

"Rajapakse attorneys again appear to depend on the Department of Justice of the United States to reassert the "suggestion of immunity" and for the Appeals judges accept, as did the trial court, to defend Rajapakse on the charges of war-crimes," legal sources in Washington said.

This is an explicit move of colonisation and structural genocide aiming for the annihilation of the territoriality of the nation of Eezham Tamils in the island for the edification of those who ask for evidence, commented civil society activists in Vanni. Why should the Tamils have territoriality in the island is a question raised by the Mahinda Rajapaksa regime that opts genocide as means and argues that anyone could settle anywhere in the island, under the blessings of the powers that insist on treating the island as one unit whether there is genocide or not, said civil society activists.

Colombo’s claims of diaspora dialogue challenged in the diaspora

0None of the Tamil diaspora bodies that have democratic or institutional mandate of Eezham Tamils have opted to engage in talks with the Sri Lankan government, which continues to negate the nationhood and right to self-determination of Eezham Tamils, said Dr Panchakulasingam Kandiah, the president of the democratically elected Norwegian Council of Eezham Tamils and a director in the board of the Global Tamil Forum. He was responding to a question by TamilNet on Saturday, on the statement of Sri Lanka's cabinet spokesperson and minister Keheliya Rambukwela telling that Colombo was “making headway in its dialogue with the Tamil Diaspora”. The ‘dialogue’ will be held in Colombo shortly under the direct patronage of SL President Mahinda Rajapaksa, media reports from Colombo said.

Tamil politicians, activists protest against SL military attacks on civic leaders in Jaffna

0Tamil politicians and civil activists on Wednesday protested condemning the brutal attack Sunday on Paramsothy Vasanthakumar, the elected chairman of Nalloor Piratheasa Chapai (PS). Vasanthakumar was on his way to prepare a legal suit after lodging a formal complaint against the illegal SL military occupation of 5 acres of land belonging to the civic body when he was attacked. The attackers, alleged to be the operatives of the SL military intelligence, had followed Mr Vasanthakumar in motorbikes, assaulted him using sharp iron rods at Kokkuvil and forcibly removed the legal documents on the SL military occupied land together with a sum of money. The protestors on Wednesday openly blamed the SL military intelligence in Jaffna for carrying out a systematic campaign of terror, targeting elected civic leaders in the peninsula.

Uprooted Maathakal residents file FR petition in SL Supreme Court

Six uprooted residents of Maathakal from the Valikaamam district secretariat division of the Jaffna district have filed a fundamental rights violation petition in the Sri Lankan Supreme Court (SLSC) last week seeking an order that they should be allowed to resettle in their own lands and houses. They have cited the SL Defense Secretary Gotabaya Rajapaksa, Commander of the Sri Lanka Army Lt. Gen. Jagath Jayasuriya, Commander of the Jaffna Security Forces Maj. Gen. Mahinda Hathurusinghe and the Attorney General as respondents.

The legal issue raised was whether the words "an individual" in the Torture Victims Protection Act (TVPA), Congress subjected to civil liability for complicity in the universal crimes of torture or extra judicial killings under color of foreign law to implement the Convention Against Torture and to advance promoting human rights abroad include the sitting head of states (Mahinda Rajapakse) sued in their individual capacities, the legal brief of the plaintiffs said.

Colombo snatches away even little power devolved to EPC: TNA councilor

The leader of the opposition in the Eastern Provincial Council, Mr C. Thandayuthapani, a Tamil National Alliance (TNA) politician, has said that the Sri Lankan government in Colombo was trying to snatch even the littler powers already devolved to the provincial administration in the Eastern Province. The comment by the TNA politician has come in the wake of EPC endorsing the controversial ‘Divineguma’ bill on Tuesday. The draft bill is a blueprint for the structural genocide of the country of Eezham Tamils, say Tamil civil officials in the East. In the meantime, the TNA has also filed a case at the SL Court of appeal against a move by Colombo to get a similar approaval from the colonial military governor in North to approve the bill in the absence of an elected provincial council in the North.

Baskaran earlier this month, Tamil Nadu activists Srinivasa Rao and P. Imtiyaz, who is currently teaching in a US university, cautioned this week the SLMC in alliance with Rajapaksa that it “should be able to read political logic of the Rajapaksa regime.” The Tamil-speaking academic, while reasoning out the bargaining politics of the SLMC, and delineating on the areas of lacuna in Tamil–Muslim understanding, further cautioned the SLMC that “Any failure or any deception, would very likely trigger tensions and distrust between Tamils and Moors.” Using the term Moors in his responses to questions put forth by a TamilNet contact in North America, Dr. Imtiyaz commented on the SLMC decision that “ It is easy to win diamonds for elites and politicians in coalition politics, but what is hard is to effectively win rights and security for the masses”.

Resettlement farce disproves claims of IOM and UN

0No one from the UN or any other international humanitarian body had come to witness the plight of the people who were forcefully relocated from IDP camp to Vattaappazhai in Mullaiththeeu and then dumped at a plot of land cleared after burning jungle at Chooripuram. The people belonging to more than 110 families languish without potable water or any basic facilities. Many of the remaining families have also been dumped at similar sites at Kaiveali and in other pockets of Puthukkuidyiruppu division. TamilNet brings out photos of Kaiveali and Chooripuram and a video clip from Chooripuram. The visuals tell the story, while the UN and IOM, who have not taken any effort to visit the site, pat their own backs and that of Colombo on fulfilling the ‘commitment’ and resettling people back in their ‘homes’ with safety and dignity.
