SL Commander of 58 Division twists lists at Mullaiththeevu Magistrates’ Court

Major General Kavinda Chanakya Gunawardena (K.C. Gunawardena) of the Vijayabahu Infantry Regiment (58 Division), which committed heinous genocidal crimes during the onslaught against Eezham Tamils had revealed to Mullaiththeevu Magistrates' Court on 17 February 2016 that there was a military document containing the names of all surrendered LTTE members in the final days of the Vanni war. He initially revealed the existence of the list thinking it was in defence of his argument that the names mentioned in a writ of habeas corpus case under hearing were not found in that list. But, on Thursday Gunawarena came up with two lists of LTTE members who have been subjected to military ‘rehabilitation’ and released.

After the unintentional revelation in February 2016 by the SL Commander of 58 Division, District Magistrate of Mullaiththeevu MSM Samsudeen demanded the SLA commander to submit the list he cited in his defence to the courts.

Since then, the commander of the ‘Vijayabahau’ Regiment has been absconding from subsequent hearings at Mullaiththeevu.

Ananthy Sasitharan (NPC Councillor), the wife of Ezhilan who witnessed the handover of her husband to the 58 Division of SL Army through a Catholic Priest at Vadduvaakal in front of her on 18 May and four other women who are still searching for their family members in the SL military custody, Jeyakumari Krishnakumar, Balananthiny Visvakumar, Gandhi Kanthasamy and Ponnam Kanthasamy were behind the writ of habeas corpus.

On Thursday, Chanakya Gunawardena appeared with two lists on a different subject.

The Magistrate had warned the SL military earlier that the SL Major General would be facing an arrest warrant if he failed to attend the hearing on Thursday.

On Thursday, the SL commander submitted two other lists, one with the details of former LTTE members who were subjected to so-called ‘military rehabilitation’ and released and the other being those still at ‘military rehabilitation’.

Rejecting the submission by the SL commander, the Magistrate reminded Chanakya Gunawardena, who is celebrated as the ‘Colonel of The Regiment’ that it was the list of surrendered former LTTE members that the court was demanding from him.

The lists Gunawardena had come up with could be easily retrieved from SL Ministry of Rehabilitation, the Magistrate commented and instructed the ‘Vijayabahu’ Infantry Division Commander to come up with the military list of surrendered LTTE members at the next hearing set to September 29.

The SL military, ‘Terrorist‘ Investigation Division and the SL Police have well-established tactics and techniques to defend their system and postpone things indefinitely under the SL judiciary. This is why Tamils have been demanding international investigations, commented a legal practitioner, who was following the case. “They are all protected by the genocidal State and its Colombo-centric judiciary,” the lawyer told TamilNet.

“When the SL genocidaires were protected by a District Court in USA using the diplomatic immunity and the UN was influenced to deploy Shavendra Silva as an advisor, what you can expect from a SL commander appearing at a domestic court run by the genocidal State of Sri Lanka,” asked the legal practitioner.

58 Division, led by Major General Shavendra Silva, was behind assassinating LTTE members who carried white flags as advised by foreign diplomats and ministers such as Erik Solheim in May 2009.

In the meantime, Colombo moved with appointing retired Major General Shavendra Silva as Sri Lanka's deputy permanent UN representative in August 2010.

Some of the war crimes committed by the 58 Division, especially at the final stages of the Vanni war in 2009, have been detailed by the Report of the Secretary General`s Panel of Experts on Accountability in Sri Lanka in 2011.

However, the retired SL commander was rescued in 2011 from a civil litigation in a New York court over war-crimes allegations.

Despite serious allegations of war crimes, Silva was also "selected" as an advisor for U.N. Secretary-General Ban Ki-moon's Senior Advisory Group.

The SL commander of 58 Division, now appearing at Mullaiththeevu Court has attended military-to-military offered training by India, China and the USA.
