Gotabhaya exonerates US-refused SL general

Genocidal Sri Lanka’s Defence Secretary and presidential sibling Gotabhaya Rajapaksa on Sunday tried to exonerate a Sinhala military general, Maj. Gen. Sudantha Ranasinghe, who was refused admission into a US military training programme on grounds that he had served the war-crimes-accused 53 Division of the SL military. The said general, recently appointed as SL Military Secretary, had not commanded the 53 Division or any other fighting formations, but he was only ‘Commissioner General of Rehabilitation’ taking over a state-run project to ‘rehabilitate’ ex-LTTE cadres in Feb 2010, Gotabhaya said, accusing the US for its blunder in the denial of opportunity to a senior officer of a friendly country to enhance his knowledge, Colombo defence writers reported on Monday.

China card becomes ‘license’ for genocidal order

With the seemingly blackmailing speech of Gotabhaya Rajapaksa, reported in Colombo media on Friday that if the USA withdraws its military training programmes to Sri Lanka, China would replace them, it becomes very explicit that the China card is now openly used for justifying a genocidal State order in the world, Tamil political analysts in the island said. Gotabhaya’s stand reported in Colombo media as “We don’t need you, we got China, Gotabhaya tells US,” is not taken seriously by Tamil political analysts, since Gotabhaya would have thrown away his US pass port if he was that ‘Sri Lankan’ and the US policy analysts and groups would not have been engaged in ‘reaching out’ Sri Lanka and engineering the integrity of the genocidal State, if Gota’s speech really means anything, the analysts said.

US Court to hear oral argument on war-crime case against Rajapakase

0United States Court of Appeals for the District of Columbia circuit has scheduled March 8th, 9:30 am for the oral argument in the appeal case against Sri Lanka's President Mahinda Rajapakse for civil damages on war-crimes charges filed by three Tamil plaintiffs whose relatives were extra-judicially executed or unlawfully killed under the "command responsibility" of Rajapakse. "The key legal issue in this case is whether the U.S.'s Torture Victims Protection Act (TVPA) deputed the Executive Branch with authority to extinguish TVPA claims against sitting heads of state based on professed foreign policy concerns," plaintiff-appellants' attorney, Bruce Fein, said. Judges Merrick Garland, Janice Brown, and Brett Kavanaugh have been assigned to hear the case, according to Court papers.

UK should exert pressure on Sri Lanka: BTF

0Referring to the systematic repression and attacks on Eezham Tamil political activists, civil society and students by the Sri Lankan state, the BTF called on the British government to “to exert serious diplomatic pressure on Sri Lanka.” Speaking to TamilNet, BTF Coordinator Ravi Kumar said that since the so-called ‘independence’, concentration of powers in the Sinhalese rulers has systematically increased and that after a successful genocidal war on the Tamil nation in 2009, now all powers in the Sri Lankan state, executive, legislative and judicial powers are concentrated under the President. “Under such circumstances, UK and the International community should not focus on internal mechanism to provide justice to the Tamil Nation. This is the time for the UK government to call for an external mechanism towards an international independent investigation,” he added.

SLFP threatens Tamils filing cases against Sinhala land grab in Ki'linochchi

Sri Lankan President Mahinda Rajapaksa's ruling Sri Lanka Freedom Party (SLFP) men in Ki'linochchi have been threatening the Tamil land owners who have been filing cases against the Sinhalese from South who have occupied their lands. The SLFP men are behind ‘providing’ lands to the family members of the Sri Lanka Army soldiers and other Sinhalese from South. At least 15 cases are pending the Ki'linochchi courts against illegal land grab of priviate lands by the Sinhala settlers from South, legal sources in Ki'lnochchi told TamilNet.

SL Archbishop collaborates with Gotabhaya in militarization land grab

The Sinhala Archbishop had come and the Tamil Bishop of Mannaar, Rayappu Joseph, was made to silently sit along with him at the conference called by Gotabhaya at Mu’l’likku’lam on 26 December, in coercing the largely Tamil Catholic villagers to the sulking reconciliation of accepting alternative offers of land, the news sources further said.

Nepalese war criminal faces torture charges in UK

"This encouraging development puts on notice persumptive war-criminals from Sri lanka who have participated or commanded extra-judicial killings, torture of civilians, and killings of surrendees, all qualifying as war-crimes during a State sanctioned massacre that comes perilously close to genocide, on visiting UK, or other European Countries where the Courts exercise Universal jurisdiction for such crimes," a spokesperson for Tamils Against Genocide (TAG) said.

Missing woman found slain, dumped inside well near SL military post in Kaarainakar

0A 27-year-old mentally disabled woman, who was reported missing from the psychiatric unit of Thellippazhai Base Hospital in Valikaamam North, was found dead in an abandoned well near Sri Lanka Navy post at Kaarainakar on Friday. The inner clothes of the victim were found torn apart and her body was recovered in a decomposed state. Medical staff at Kaarainakar hospital and Moo’laay cooperative hospital told TamilNet that two SL policemen had come to their hospital with the mentally disabled female on 07 December seeking medical assistance. However, the SL policemen, when contacted by the relatives of the victim have ‘explained’ that they had dropped the female at Valanthalai junction situated at the entrance to Kaarainakar, around 1:30 a.m. on 08 December.

Reminding the Australian Prime Minister that what had happened in Sri Lanka was genocide, and the regime is a set of pathological liars, Brian said: “Mr Carr has enhanced the ability of this murderous regime to commit gross violations of human rights by doing what he has just done in Colombo – saying that Australia will help the Sri Lankan Navy to stop people fleeing from the murderous regime in Sri Lanka.”

EPDP accuses occupying SL military for inaction on child rape, murder

Why the Sri Lankan forces that were quick in arresting those who were hoisting Tiger Flags is unable to arrest the culprit behind the heinous crime, the EPDP demonstrators questioned. The girl child, Chudarini Gunasegaram reported missing from her house at Ma’ndai-theevu in Jaffna on 27 December, was found slain and dumped into an abandoned well the following day, with traces of rape in brutal ways.

Systemic disappearances qualify as crimes against humanity in ICC, says Boyle

"So if Gotobhaya travels to an ICC Member State, it might be possible to get him prosecuted in the visiting country under its domestic implementing legislation for the Rome Statute," Boyle said.

SL Commander threatens VC-led team visiting Palaali

Following the refusal of the Deans of the University of Jaffna to meet the SL commander of the occupying forces at Palaalai military base on Wednesday, the Vice Chancellor of the University of Jaffna on Friday morning led a team to meet the SL commander at Palaali. The team included many of the deans, heads of departments and parents of the detained as well released students. The SL Commander Maj. Gen. Mahinda Hathurusinghe threatened the visiting team that if they insist on the release of the detained students for the re-opening of the University, then there will be no chance of the students getting released. He ignored the pleading and crying parents of the students, who attempted to prostrate before him.

Deans foil SL military attempt to direct Jaffna University

Mahinda Hathurusinghe now ventures to directly order the academics and to run the University of Jaffna from his military base at Palaali, news sources in Jaffna said, citing his call to the deans of the faculties to meet him at Palaali on Wednesday to talk to them on resuming classes at the university. All the faculty deans in unison rejected the call and told the Vice Chancellor that it amounts to militarisation of education. Meanwhile, the talks between the Student Council and the Vice Chancellor of the university on Wednesday failed as the students have categorically conveyed their decision of not attending to classes until all the student leaders detained by the SL military are released.

Tamil Nadu protest calls for investigation on 3 UN officials for complicity in Tamil genocide

May 17 Movement, the organisers of the protest, citing the recent report of the Internal Review Panel on UN Action in Sri Lanka led by Charles Petrie, accused the ‘axis of the UN trio’ for shielding the Sri Lankan government during the peak of its genocidal onslaught on the Eezham Tamil nation. The demonstrators, who blamed the UN for denying justice to the victims after the genocidal war, also accused the UN for having failed to provide a just political solution to the national question of Eezham Tamils.

TNPF condemns Sampanthan’s statement on SL military, LTTE

The Tamil National People’s Front (TNPF) on Tuesday strongly condemned the SL parliamentary speech made by Tamil National Alliance (TNA) leader R. Sampanthan last Friday. Mr. Sampanthan had said that the TNA was not demanding the complete withdrawal of the SL military from the Tamil territory and that the LTTE had had earned its destruction by being a ‘terrorist’ organization not observing human rights and democracy and by engaging in the killing of Tamil, Muslim and Sinhala leaders. The statement coming from the leader of the TNA should be taken as the policy stand of the TNA. Neither the constituent parties of the TNA nor its parliamentary members have so far contradicted the statement, said the TNPF press release, signed by its president Gajendrakumar Ponnambalam and secretary, Selvarasa Kajendran.

Colombo hatches new strategies in genocidal war, sidelines EPDP

One of the new strategies of Colombo in waging its on-going genocidal war against Eezham Tamils is tagging spontaneous uprisings resulting from its genocide in the island as linked to ‘diaspora terrorism’. Colombo’s strategy is nothing but a manifestation of the attitude of the guilt-filled International Community of Establishments (ICE) and its groups, outfits etc., that see the diaspora as their enemy and attempt to silence the diaspora opinion by projecting it as ‘linked’ to ‘terrorism,’ political observers in the island said. Meanwhile, Colombo now sidelines the EPDP and cultivates its own collaborators in the North, the observers further said, citing many recent developments. ‘Use and dump’ will not stop with Karuna, Pillaiyaan and Douglas, but would proceed even to those who were long recruited for the agenda of the ICE, the observers further commented.

Fein: U.S.'s immunity determinations flout due process

0In the final legal brief filed with the United States Court of Appeals in the case against Sri Lanka's President Mahinda Rajapakse for civil damages on war-crimes charges, appellants, Dr Manoharan et al.'s attorney Bruce Fein asserts that "[n]either the Constitution, nor the Torture Victim Protection Act (“TVPA”), nor customary international law (“CIL”) crowns the Executive with exclusive authority to determine whether a sitting head of state is immune from a TVPA suit founded on the grisly and universally abhorred crimes of torture or extrajudicial killing under color of foreign law," and argues that the Court should reject the U.S. State Department's contention that "when the Executive speaks on immunity, the judiciary is ousted of jurisdiction to interpret the law, [and that the] Adjudication of the case moves from Article III courts to the Article II President."
